Dear Sir/Dear Madam:
For the record I would like to inform you that until today, November 29, 2004, i.e. for six weeks since my deportation from Spain (carried out in collaboration with your authorities) I have been denied visits from lawyers, my family and even my partner who traveled from Andalusia four times in the hope of seeing me.
December 1, the day after tomorrow, marks the deadline for an appeal with the Cour de Cassation. I could not, or was not allowed to, discuss any of it with my lawyers. The French authorities have systematically prevented it. Now we can say: The matter is in the hands of the Cour de Cassation, and this may take two or even three years.
Please be informed as well that, as a German citizen, I feel I was utterly betrayed by the German government and the German Embassy in Paris. When Ms. Jäger writes that she would meet with lawyer XX (?) before December 1 to make sure that the deadline was respected, I take it that this was meant merely to offer the usual thin-lipped and meaningless words of comfort…. It was the intention of the French – and likely also the German – authorities, or the Foreign Office, to make sure I would not have access to a lawyer and therefore miss the deadline.
When Ms. Jäger from the German Embassy saw me on November 16, 2004, almost two weeks ago, we agreed that the German government should assume the task of contacting their French counterpart to ensure French compliance with the statutes of the „Euro order”.
One of the statutes declares that:
· If the verdict (e.g. against me in France) was handed down in absentia and
· If the accused, who was convicted in a court of the first or second instance, is deported (e.g. to France), the accused has a right to the trial being immediately referred back to the first instance.
I had lodged an urgent demand with Ms. Jäger to see to it that the German Embassy immediately issue a written request the French government ensuring France’s compliance with the statutes of the Euro order. She responded to me on November 20, but her letter made no mention of any initiative by the German government directed at the French authorities in support of a citizen of its country. On the contrary, I must assume that she was clearly instructed by the Foreign Office not to do so.
Now we have come full circle – only in the other direction – just as from 1978 to 1991, when Mr. Genscher ordered the German Embassy in Paris to deny any support to the Hamer family in their proceedings against the killer of their son Dirk, no matter what the circumstances!
At that time in 1991 – 13 years after the crime! – judge Colomb presided over a new jury especially convened for this case. After recommending to the murderer to retract his written confession, he personally accorded an outrageous, literally insane, completely theoretical and microscopically tiny shred of doubt with a „probability” of 1:10 million. He rose theatrically and announced: „We have a doubt – in dubio pro reo! The prince is innocent.”
Now things are the other way around: Typically for the arbitrary French way of delivering justice, the inquisition in Chambery has construed another „culpa”, just as outrageous, irrationally insane and completely theoretical. A wrong committed by me almost 9 years ago with the publication of my books, to the detriment of 3 patients, unknown to me, who had finished their chemotherapy rounds at the hospitals, and who were sent home to die. It is implied that I indirectly prevented these patients, who were unknown to me since I had left France 12 years earlier, from subjecting themselves to more chemotherapy before their deaths.
The judge is said to have risen and announced: „We have a teeny tiny theoretical indirect „Culpa”, (1:10 million) – in dubio ... – The heretic is guilty! Three years of prison!

My former lawyer Mendel commented the verdict handed down by the inquisition in Chambery as follows:
"With this verdict France has clearly closed the door to the community of European civilizations!"
This is so typical for the arbitrary French justice system!
Obviously the German government – just as from 1978 until 1991 under Genscher – has issued instructions for the second time not to help me and the Hamer family.
